Federal Appeals Court Strikes Down Michigan’s Ban on Conversion Therapy for Minors, Citing First Amendment

6th Circuit blocks Michigan’s 2023 law banning conversion therapy for LGBTQ+ minors, ruling it violates therapists’ free speech rights in 2-1 decision

Newsroom (19/12/2025 Gaudium Press ) A divided panel of the U.S. Court of Appeals for the 6th Circuit on Wednesday blocked enforcement of Michigan’s 2023 law prohibiting conversion therapy for minors identifying as LGBTQ+, concluding that the measure unconstitutionally restricts the speech of licensed therapists and counselors.

In a 2-1 decision, the court granted a preliminary injunction sought by Catholic Charities of Jackson, Lenawee, and Hillsdale Counties, setting aside a lower court ruling that had upheld the ban. The majority held that the law engages in impermissible viewpoint discrimination by allowing counseling that affirms a minor’s gender identity or sexual orientation while prohibiting therapy aimed at changing it.

“The Michigan law discriminates based on viewpoint — meaning the law permits speech on a particular topic only if the speech expresses a viewpoint that the government itself approves,” wrote Judge Raymond Kethledge for the majority, joined by Judge Joan Larsen. The judges emphasized that the statute permits counselors to assist clients undergoing gender transitions but bars efforts to align a minor’s identity with their biological sex.

The ruling arrives as the U.S. Supreme Court considers a related challenge from Colorado that could establish a nationwide precedent. Oral arguments in that case were heard more than two months ago.

Michigan’s law, passed by a Democratic-controlled Legislature and signed in 2023 by Gov. Gretchen Whitmer, classified conversion therapy as a “horrific practice.” Violations could result in the loss of professional licenses. More than 20 other states have enacted similar restrictions.

In dissent, Judge Rachel Bloomekatz argued that the 6th Circuit should have deferred action pending the Supreme Court’s forthcoming decision.

Attorneys representing the counselors hailed the outcome as a significant win. “This is a victory for children nationwide,” said Luke Goodrich, senior counsel at Becket and lead attorney for the plaintiffs. Goodrich contended that the Michigan law “was pushing children toward irreversible medical procedures that cause lasting harms,” adding that the ruling “ensures that children who want it can receive compassionate, evidence-based counseling that alleviates their distress and helps them embrace their bodies without resorting to irreversible, life-altering medical interventions.”

LGBTQ+ rights advocates, meanwhile, have pointed to research indicating that conversion therapy can elevate risks of depression and suicide among minors.
